Terms and Conditions (AGB)

Section 1 Scope of Application

These Terms and Conditions apply to the use of the web-based service IntrastatAI (hereinafter the "Service"), which supports the automated creation of Intrastat reports using AI technology.

The Service is operated by Clemens Strobl (hereinafter the "Provider") as a private project and is currently provided free of charge as a beta version.

By using the Service, the user agrees to these Terms and Conditions.

Section 2 Description of Services

IntrastatAI enables businesses to upload incoming invoices (as PDFs) and automatically extract and suggest information such as commodity codes (CN codes), countries of origin, net mass, and statistical values for Intrastat reports.

The results generated by the Service are based on AI models (large language models) and machine learning. They serve as decision support and do not replace expert review by the user or a customs/tax advisor.

The Provider reserves the right to change, expand, or restrict the scope of functions of the Service at any time, in particular during the beta phase.

Section 3 Free Beta Operation

The Service is currently provided free of charge. The Provider reserves the right to introduce a pricing model after the beta phase concludes. Users will be informed of this in due time.

There is no entitlement to permanent free use.

Section 4 User Obligations

The user undertakes to:

  • use the Service only for lawful purposes in connection with Intrastat reporting;
  • not upload personal data of third parties without their consent, unless this is strictly necessary for the processing of the invoice;
  • review the generated results on their own responsibility before submission to authorities;
  • not carry out automated mass access (scraping, bots) to the Service.

Section 5 Uploaded Documents and Data Protection

Uploaded PDF documents are used exclusively for processing the respective Intrastat report. The content of the PDF file is irrevocably deleted immediately after the automatic processing is completed. Only the extracted structured data (e.g. goods descriptions, commodity codes, quantities, amounts) is stored for display and export.

The Provider does not disclose uploaded documents to third parties, with the exception of the AI services (language models) used for processing, to which text content is transmitted for analysis.

The user is responsible for ensuring, prior to uploading, that they are authorized to process the data contained therein.

Section 6 Disclaimer of Liability

The Service generates suggestions based on AI models. These may be inaccurate, incomplete, or outdated. The Provider assumes no liability whatsoever for:

  • the accuracy, completeness, or currency of the generated commodity codes, country codes, or other information;
  • damages arising from the use of incorrect AI outputs, in particular fines, back payments, or regulatory measures;
  • downtime, data loss, or technical errors of the Service;
  • damages resulting from unauthorized third-party access to user data, provided the Provider has exercised the required due care.

This limitation of liability does not apply in cases of intent or gross negligence on the part of the Provider, or in the event of damages resulting from injury to life, limb, or health.

Section 7 Availability of the Service

The Provider strives for high availability of the Service but does not guarantee uninterrupted or error-free provision. Maintenance work, updates, or technical faults may lead to temporary interruptions.

Section 8 Intellectual Property

All rights to the software, design, and content of the Service belong to the Provider or the respective rights holders. Use of the Service does not confer any rights to this content.

Documents uploaded by the user and the export files generated from them remain the property of the user.

Section 9 Changes to the Terms and Conditions

The Provider reserves the right to amend these Terms and Conditions at any time. Changes will be published on this page. Continued use of the Service after a change constitutes acceptance of the amended version.

Section 10 Governing Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes is Vienna, to the extent legally permissible.

Section 11 Final Provisions

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
